Terms of Service

Welcome to Apex-Global-Consulting ("Apex", "we", "us" or "our"). These Terms of Service ("Terms") govern your use of our website at apex.lsa-now.com and any consulting, evaluation, application support or related services we provide (together, the "Service").

By creating an account, signing in, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Service.

Apex is an education-consulting firm. We help prospective students apply to universities and academic programs abroad. Depending on the plan you engage us for, our Service may include:

• Profile evaluation and university shortlisting.
• Guidance on standardised tests (SAT, GRE, GMAT, IELTS, TOEFL, Duolingo).
• Statement of Purpose (SOP), essay and Letter of Recommendation (LOR) review.
• Application form assistance and document management through your dashboard.
• Scholarship and financial-aid research.
• Visa preparation guidance and mock interviews.
• Pre-departure and on-arrival support.

We are an independent consultancy and are not an agent or representative of any university unless expressly stated in writing. Final admission and scholarship decisions are always made solely by the university or awarding body.

You may use the Service only if you can form a binding contract with Apex under applicable law. If you are under 18, you must have the consent and supervision of a parent or legal guardian, who accepts these Terms on your behalf.

• Provide accurate, current and complete information when you sign up.
• Keep your password confidential and enable two-factor authentication where offered.
• You are responsible for all activity under your account.
• Notify us immediately at privacy@lsa-now.com if you believe your account has been compromised.

To make the Service work, you agree to:

• Provide accurate, truthful and complete information about your academic and personal background.
• Upload only documents you have the right to share.
• Not submit forged, altered or fraudulent documents. Universities routinely verify credentials; misrepresentation can lead to withdrawn admissions and immigration consequences that Apex cannot reverse.
• Respond promptly to requests for information, drafts and application deadlines.
• Comply with the rules, application requirements and honour codes of any university or test agency you engage with.
• Use the Service only for lawful, personal purposes and not resell or commercialise it.

Some features of the Service are free (creating an account, profile evaluation, dashboard access). Fee-based consulting engagements are governed by a separate service agreement or invoice we share with you before you commit. Unless stated otherwise in writing, fees are non-refundable once work has begun.

Important. Any scholarship figures we cite anywhere on our site or marketing materials — including the aggregate figure of ₹42 Cr (approximately US$5 million) — are indicative totals based on past awards secured by students we have advised. They are not a promise, guarantee or offer of any specific scholarship, financial-aid amount or admission outcome to any individual applicant.

Actual scholarship and admission outcomes depend on many factors outside our control, including:

• Your academic record and test scores.
• The strength and authenticity of your application materials.
• The applicant pool in a given intake.
• Each university's evolving policies, budgets and eligibility criteria.
• Visa and immigration decisions.

We do not promise admission to any specific university, any specific scholarship amount, any specific visa outcome, or any specific ranking. We commit only to providing our services with reasonable skill and care.

The Service, including the website, dashboard, logos, text, graphics, templates and software, is owned by Apex or its licensors and is protected by copyright, trademark and other laws. You may use it only as permitted by these Terms.

You retain ownership of the content you upload (your transcripts, essays, SOP drafts, LORs, etc.). You grant Apex a limited, non-exclusive licence to store, copy, transmit, review and share those materials with universities and processors as needed to provide the Service.

The Service integrates with third parties, including Google (OAuth, Drive, Sheets), Supabase, Cloudflare, universities and government authorities. Your use of those services is subject to their own terms and privacy notices. We are not responsible for the availability or actions of any third party.

You agree not to:

• Use the Service to violate any law or the rights of others.
• Submit false, misleading, plagiarised, AI-fabricated or forged materials.
• Attempt to gain unauthorised access to the Service, other user accounts, or our infrastructure.
• Interfere with, disrupt, reverse-engineer or overload the Service.
• Scrape, copy or resell the Service or its content.
• Upload malware, viruses or otherwise harmful code.

We may change, suspend or discontinue any part of the Service at any time. We will try to give reasonable notice of material changes that affect paid engagements. We may also update these Terms; continued use of the Service after an update means you accept the revised Terms.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, if we suspect fraudulent or abusive activity, or if we are required to do so by law.

Sections that by their nature should survive termination — for example, disclaimers, limitation of liability, indemnity, and governing law — will continue to apply after your account ends.

The Service is provided "as is" and "as available". To the fullest extent permitted by law, Apex disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation.

Nothing on the Service constitutes legal, immigration, tax or financial advice. University and visa decisions rest solely with the relevant institutions and authorities.

To the maximum extent permitted by law, Apex and its officers, employees and affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data, admissions, scholarships or goodwill, arising out of or related to your use of the Service.

Our total aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid Apex for the specific engagement giving rise to the claim in the 12 months before the claim arose, or (b) US$100.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

You agree to indemnify and hold Apex harmless from any claims, losses, liabilities and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or your submission of false or infringing materials.

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of laws rules.

We prefer to resolve disputes amicably. Before filing any formal claim, please contact us at legal@lsa-now.com so we can try to resolve the issue within 30 days.

If we cannot resolve the dispute, it will be settled by binding arbitration in Bensalem, Pennsylvania, under the then-current rules of the American Arbitration Association, except that either party may bring an individual claim in small-claims court. To the extent permitted by law, you and Apex waive the right to trial by jury and the right to participate in a class action.

• These Terms, together with the Privacy Policy and any signed engagement letter, are the entire agreement between you and Apex.
• If any provision is found unenforceable, the remaining provisions stay in effect.
• Our failure to enforce a right is not a waiver of that right.
• You may not assign these Terms without our prior written consent; we may assign them to an affiliate or in connection with a merger or acquisition.
